How to Challenge a Code 01 PCN: Yellow-Line Parking

Code 01: Parked in a Restricted Street During Prescribed Hours

Code 01 concerns waiting on a restricted street, usually on a single or double yellow line. It is not an allegation that you failed to buy a parking ticket. Paying at a nearby machine does not give permission to wait on a yellow line, and remaining inside the vehicle does not by itself prevent a contravention.

The useful question is why this particular stop was not prohibited. The restriction may not have been operating, the signs may not have conveyed it adequately, or an exemption may have covered what you were doing. Explain that point precisely and show the evidence that supports it.

Informal Challenges and Formal Representations

• PCN fixed to the vehicle or handed to the driver: send an informal challenge to the issuing authority using the address or online form on the PCN. Provide the code-specific facts and evidence while the notice is current.
• Notice to Owner: if one is served, the owner must make formal representations within the period stated on that notice, normally 28 days beginning with service. An earlier informal challenge does not replace this step.
• Postal parking PCN: make formal representations against the postal PCN. Do not wait for a separate Notice to Owner. Postal service must be authorised, for example an eligible camera contravention, prevented service or a qualifying drive-away.
• Notice of Rejection: an independent tribunal appeal is normally due within 28 days beginning with service. London cases go to London Tribunals; relevant cases elsewhere in England and Wales go to the Traffic Penalty Tribunal.

For civil parking enforcement in England, read the 2022 General Regulations together with the separate 2022 Representations and Appeals Regulations. The traffic order and signs establish the local restriction; the enforcement regulations govern the notice and challenge process. Wales has separate regulations.

Code 01 Deadlines, Discounts and the 56-Day Decision Period

A Code 01 PCN fixed to the vehicle or handed to the driver normally offers a 14-day discount. Send an informal challenge promptly. Whether the discount is offered again after rejection depends on the authority's policy and response; do not assume every early challenge freezes it.

• A Notice to Owner normally requires formal representations within 28 days beginning with service. Reply to it even if you already challenged the original PCN.
• For qualifying formal parking representations in England, the authority must serve its decision within the statutory 56-day period. This is not an automatic 56-day cancellation rule for an informal challenge.
• After a formal Notice of Rejection, the normal tribunal appeal period is 28 days beginning with service. Follow the rejection's instructions and retain the submission confirmation.

Code 01 is a higher-level London borough parking contravention. London Councils lists the full penalty as £160 in Band A or £140 in Band B, with a 50% discount where applicable. Elsewhere, check the amount and legislation on the notice. There is no general ten-minute grace period for waiting on a yellow line.

Evidence for a Code 01 Yellow-Line Challenge

Start with the authority's photographs and observation notes. Then add evidence that answers the reason for the PCN, not an unrelated bundle of parking information.

• Restriction hours: photographs showing the line, the relevant time plate or zone entrance, the street name and where the vehicle stood.
• Loading: the delivery or collection record, goods involved, premises visited and a timeline from stopping to departure. Explain any necessary interval when nobody was beside the vehicle.
• Boarding: a passenger or witness account showing when the passenger was ready and why assistance took that time. Provide only the medical information needed to explain the assistance.
• Blue Badge: a copy of the valid badge, evidence of the displayed clock and arrival time, and the local concession relied on.
• Wrong restriction or location: the relevant traffic-order extract and map, compared with the officer's photographs. Request the specific restriction and any amendments covering the date of the PCN.

If the council has not supplied a requested record, identify what is missing and why it matters. Missing evidence is not proof by itself that the restriction did not exist. Do not let a request for photographs or an order cause you to miss the challenge deadline.

When a Yellow-Line PCN Can Be Challenged

A yellow line does not answer every question about the stop. Compare the PCN's place and time with the restriction, then explain any permitted activity. Keep a request for discretion separate from an argument that no contravention occurred.

• The single-yellow restriction was not operating. Photograph the applicable time plate or the controlled-zone entrance used and compare its hours with the PCN time. A bay sign next to a yellow line may govern the bay, not that line.
• Loading or unloading was permitted and actually taking place. Identify the goods, collection or delivery address, and the time reasonably needed. An invoice, delivery confirmation and a short account from the recipient can explain activity that happened out of the officer's view. Buying goods or waiting to meet somebody is not automatically loading.
• A passenger was boarding or alighting under an applicable exemption. Explain the passenger's needs, the assistance given and the time taken. Distinguish necessary assistance from waiting before the passenger was ready.
• A qualifying Blue Badge concession covered the stop. Show the badge, correctly displayed clock, arrival time and local concession. In England the usual yellow-line allowance is up to three hours where loading is not prohibited, but special central-London rules and other conditions must be checked.
• The restriction was not adequately indicated. Show the sign or marking as it appeared from your actual approach and parking position. Explain the obstruction, contradiction or missing information; a close-up of worn paint alone may not establish that the restriction was unclear.
• The recorded location, vehicle or time is wrong. Compare the PCN with the officer's photographs and notes. Show why the discrepancy changes the allegation, rather than relying on a harmless spelling error.

Code 02 alleges a loading restriction as well as a waiting restriction, so the same loading explanation may not answer it. A breakdown, medical emergency or another exceptional event also needs a dated account and supporting records; whether it is an exemption or mitigation depends on the applicable restriction and facts.

Explain Why Your Stop Was Permitted

State the PCN reference, registration and location, then describe the activity or restriction error in date-and-time order. Identify the evidence beside the fact it supports and ask the authority to cancel the PCN. Do not claim an exemption simply because it appears on a list; explain how its conditions were met.

For example, a delivery challenge should say what was unloaded, where it was taken, when the activity started and finished, and why the vehicle needed to stop there. Attach the delivery record and address any loading restriction shown in the council's photographs. An assisted-boarding challenge needs a different explanation; it should not be copied from the delivery example.

Send the Challenge to the Issuing Authority

Use the online representation form or postal address printed on the current notice. Include the PCN reference and registration, retain copies of all evidence and keep the submission confirmation. The issuing authority is the first decision-maker; the tribunal deals with an appeal after formal rejection.

If the Authority Rejects the Challenge

An informal rejection does not end the statutory parking process. Formal rejection provides the tribunal appeal instructions. Address the reasons given, keep the earlier evidence and submit the appeal in time. If the case is upheld, the penalty is cancelled; if refused, follow the decision's payment instructions. Failure to respond can lead to a Charge Certificate and later enforcement.
