Pay a Worthing Penalty Charge Notice

A Penalty Charge Notice is a civil penalty issued by a local authority, Transport for London or another statutory enforcement authority. It may concern parking, a bus lane, moving traffic, a road-user charging scheme or another civil traffic restriction.

The document should identify the authority, vehicle, location, date, alleged contravention, penalty amount, discount, payment period and challenge method. A PCN fixed to a vehicle can begin with an Informal Challenge. A postal PCN may begin at the Formal Representation stage. The actual notice determines which response is available.

GOV.UK states that a PCN is usually payable within 28 days and may be reduced if paid within 14 days. Some camera-issued notices provide a 21-day discount. Read the current PCN rather than assuming one timetable applies to every parking, bus lane or moving traffic penalty.

Paying can be the appropriate outcome when:

• the authority's photographs or video clearly establish the contravention;
• the restriction and signs were clear and no exemption applies;
• no payment, permit, Blue Badge, loading, ownership or procedural evidence supports cancellation;
• the authority has rejected the representation and the reasons answer the material grounds;
• the discounted amount is still available and is preferable to risking the full penalty;
• an independent adjudicator has refused the tribunal appeal; or
• a hire company has already paid the PCN under the rental agreement and the remaining dispute concerns its recharge or administration fee.

Pay the amount and use the method stated on the current notice or decision. Keep the receipt and confirm that the PCN balance has closed.

Challenge a newly issued PCN when the alleged contravention did not occur, the evidence does not establish it, an exemption applies, the authority is pursuing the wrong person, the penalty exceeds the amount due or the authority has not followed the applicable statutory procedure.

The evidence depends on the PCN. Parking cases may require permits, payment records, loading evidence, photographs or a Traffic Regulation Order. Bus lane and moving traffic cases may depend on the complete video, approach signs, road markings, vehicle movement and the wording of the traffic order.

The Department for Transport's statutory guidance says authorities should consider challenges and representations fairly, impartially and with proper consideration of discretion. A valid challenge should identify the exact ground and connect it to the evidence rather than merely state that the penalty feels unfair.

If you intend to challenge the PCN, do not pay it first. Authorities normally treat payment as settlement and close the case.

Paying during the discount period normally reduces the penalty by 50%. A parking PCN served at the vehicle commonly allows 14 days. The period can be 21 days for some postal or camera-issued PCNs. The precise deadline is printed on the notice.

An early challenge can preserve the discount where the authority's published policy says it will reoffer the reduced amount after rejection. That practice is common but not identical across every authority and PCN type. Check the notice and authority guidance before relying on it.

If the PCN appears challengeable, submitting the challenge during the discount period allows the authority to consider cancellation while a reduced payment option may remain available. If the evidence confirms the PCN and no ground applies, paying within the discount period avoids the full amount.

An Informal Challenge rejection does not always end the statutory process. For a parking PCN served at the vehicle, the registered keeper may later receive a Notice to Owner and make Formal Representations. The rejection should explain whether the discount has been reoffered and the date by which it must be paid.

A Notice of Rejection of Formal Representations creates a direct choice: pay the amount stated or appeal to London Tribunals or the Traffic Penalty Tribunal, normally within 28 days of service. GOV.UK's challenge guidance confirms that the Notice of Rejection provides 28 days to pay or use the independent tribunal.

Pay where the rejection properly answers the evidence and no material ground remains. Continue to the tribunal where the authority has not proved the contravention, has not addressed the representation or a supported statutory ground remains unresolved.

An allowed appeal cancels the PCN and nothing is payable. A refused or dismissed appeal leaves the penalty payable, normally at the full amount. The adjudicator's written decision should state the outcome and the authority's payment instructions.

The Traffic Penalty Tribunal provides a direct authority payment link after an unsuccessful online appeal. London Tribunals explains that payment is normally required within the period following the adjudicator's decision before the authority can increase the penalty.

Pay after a tribunal refusal unless there is a genuine basis for the limited review procedure or specialist advice supports a further court challenge. A review is not a second appeal simply because the motorist disagrees with the decision, and requesting one does not automatically suspend the payment deadline.

The registered keeper is normally the person pursued for a Penalty Charge Notice, but qualifying hire arrangements can allow liability to be transferred. The hire company may make Formal Representations and provide the signed hire agreement and statement of liability required by the relevant legislation.

If the authority accepts the transfer, it cancels the notice issued to the hire company and issues a fresh PCN or Notice to Owner to the hirer. The hirer can then pay or make the challenge available under that notice. Newham Council's hire-vehicle guidance illustrates this process and warns hire firms not to pay if they intend to transfer liability.

Where the hire company has already paid the PCN, the statutory appeal may have ended. Check the rental agreement, payment record and administration charge. Where the PCN has been reissued to the hirer, do not pay merely because the vehicle was hired; assess the contravention and the hirer's own appeal rights first.

When the discount period has ended but the ordinary response period remains open, the choice is generally between paying the full penalty and making the challenge or Formal Representations available under the current notice.

If no supported ground exists, pay before the deadline to prevent the case escalating. If the full penalty is already due and Formal Representations remain available, a supported representation can still reduce the amount to zero without creating an additional charge merely because the authority considers it.

Do not ignore a Notice to Owner or postal PCN because an earlier Informal Challenge was submitted. The new document creates its own formal deadline. Missing it can result in a Charge Certificate that increases the unpaid penalty by 50%.

Pay the enforcement authority named on the PCN through its official portal, telephone service or postal method. GOV.UK's council payment service can locate a council payment page by postcode. Transport for London and road-user charging PCNs use their own official payment services.

You will normally need the PCN reference and vehicle registration. Confirm that the website displays the correct vehicle, authority and current balance before paying. Retain the receipt, confirmation number and date.

Treat unexpected payment text messages with caution. GOV.UK warns that the Department for Transport does not issue parking fines or send payment demands for council PCNs. Find the authority independently rather than relying on an unsolicited link.

An unanswered PCN can progress through the statutory enforcement process. A Notice to Owner or formal postal notice may be followed by a Charge Certificate, which normally increases the penalty by 50%. The authority can then register the unpaid penalty as a debt and serve an Order for Recovery.

If the Order for Recovery is not paid or answered using a truthful statutory ground, the authority can obtain a warrant and instruct enforcement agents. The later Traffic Enforcement Centre process is not a general opportunity to repeat the original PCN appeal.

The correct time to decide is therefore the current stage: appeal promptly where the notice or evidence can be challenged, or pay within the available period where the penalty is accepted and no supported ground remains.
