Why Free Car Parks Issue Parking Charges

Free parking usually means no parking tariff for an authorised visit, not permission to leave a vehicle indefinitely. The signs may limit the stay, reserve spaces for customers or require a registration to be entered inside the premises. Identify which of those terms the operator says was broken.

In ParkingEye v Beavis, decided on 4 November 2015, the Supreme Court upheld an £85 charge at a retail park with a two-hour free stay. That decision is a reason to examine the actual signs and circumstances, rather than argue only that the car park was free or the operator lost no parking fee.

    Check the Maximum Stay and Customer Registration Rules

    Photograph the entrance and the signs near the space used. Check whether they describe a continuous maximum stay, a no-return period or a requirement to validate parking at a till, reception desk or tablet. A shopping receipt establishes a customer visit, but it does not automatically remove a clearly stated maximum stay.

    If the visit involved two separate stops, set out both arrival and departure times. Ask the operator to check for missing intermediate camera images instead of accepting the first entry and last exit as one continuous stay.

      The Parking Notice and Appeal Deadline

      Keep every page of the notice and record when it arrived. A windscreen Notice to Driver, a postal Notice to Keeper and a Notice to Hirer have different requirements. The deadline for sending an appeal is not the same as the deadline an operator must meet when delivering a notice to establish keeper liability.

      Use the appeal deadline printed on the notice and send the challenge promptly. If a discount is still available, check what the operator says will happen to it during an appeal. Do not assume that a shop complaint or a request for photographs extends the appeal deadline.

        Receipts, Validation Records and Separate Visits

        Collect records that answer the alleged overstay or failure to register, rather than sending unrelated purchase history.

        • Receipts or appointments from the businesses visited, with times where available.
        • Confirmation from the store or reception that the vehicle was registered or should have been validated.
        • Dashcam, journey or location records showing a departure and later return when two visits have been combined.
        • Photographs showing the maximum stay, no-return condition and location of any validation instructions.

        Challenge an Incorrect Visit Record or Unclear Validation Requirement

        If the camera record combines two visits, identify the missing exit and re-entry. If validation failed, describe what staff said and what the terminal displayed. Where disability-related needs extended the visit, explain the additional time or assistance needed and ask for those circumstances to be considered.

        The store or retail park manager may also be able to request cancellation. Send evidence of the customer visit, ask for written confirmation of any cancellation, and continue to meet the operator's appeal deadline while the complaint is considered.

For failed validation, attach the receipt and any staff confirmation. Keep a request for discretion distinct from evidence that the charge was issued incorrectly.

Read the rejection for the appeal reference, eligibility and deadline. If the dispute continues, identify whether you have received a reminder, a debt letter, a Letter Before Claim or an actual County Court claim form. Each calls for a different response.
