1. What does Enfield Code 16 mean?
Code 16 concerns a permit space or zone where the required valid virtual permit or displayed physical permit was missing. These spaces can be reserved for particular users, not simply anyone who has a council parking account. Read the permit identifier, user description and hours on the sign before deciding what evidence answers the PCN.

2. What must Enfield establish?
Check the named permit type, identifier and operating hours, together with any relevant zone entrance. Business, doctor and car-club spaces can require different authorisation.
Locate the vehicle against the sign's arrows and the adjoining spaces. Where residents' permits are accepted, also check whether the residents' or shared-use allegation is the appropriate one.

- The space or zone must be reserved for the permit type or user identified by the applicable parking order and sign.
- The restriction must cover the actual space and PCN time, including any change to another permitted use outside those hours.
- Compare the required identifier with the active virtual permit or properly displayed physical permit, including registration and effective dates.
- A waiver or exception must cover this reserved use. A general residents' permit, Blue Badge, payment or professional status does not itself replace the particular permit required.
3. Grounds and exemptions for a Enfield Code 16 appeal
The statutory ground must match what happened. These code-specific points explain how to establish it.
A parking order may permit necessary loading, passenger assistance or specified statutory work, but the exception must cover this reserved space. A Blue Badge, a paid parking ticket or being a doctor does not itself replace a particular permit required by the sign.
- The correct virtual permit was active for the vehicle and place. Provide its type, identifier, registration and effective dates, including the confirmation of any replacement vehicle.
- The physical permit was valid and displayed in the prescribed way. Use the council's photographs and the permit details to address an alleged obstruction, expiry or wrong permit type.
- The sign did not reserve the space for that permit at the recorded time, or the vehicle was in an adjoining differently controlled space. Show the whole sign and the change in bay boundaries.
- The council accepted a waiver or specific authorisation covering this use. Produce the written approval with its location, period and conditions; a permit valid elsewhere does not establish the same permission.
- The alleged parking contravention did not happen, including where a relevant exemption applied or the restriction was not adequately signed.
- You were not the owner at the relevant time: you never owned the vehicle, sold it before the event or acquired it afterwards.
- The vehicle was under someone else's control without the owner's consent at the time of the alleged contravention.
- You are a vehicle-hire firm and the vehicle was hired under a qualifying agreement with a signed statement accepting PCN liability. Supply the hirer's name and address.
- The authority is demanding more than the penalty legally applicable to this case.
- The authority failed to comply with a statutory requirement in imposing or recovering the penalty: a procedural impropriety.
- The traffic order relied on is invalid, except an order subject to Part 6 of Schedule 9 to the Road Traffic Regulation Act 1984.
- For a postal PCN relying on prevented service or a qualifying drive-away under regulation 10(2)(b) or (c), nobody prevented the officer from attaching or handing over the PCN. This is not the ground for an approved-device postal PCN.
- The enforcement notice should not have been served because the penalty was already paid in full, or at the valid discounted amount by the applicable deadline. Paying a parking tariff is different from paying the penalty.
4. How to make a formal representation to Enfield
For a parking PCN attached to the vehicle or handed to the driver, send an informal challenge to Enfield. Formal representations are made against the Notice to Owner, or directly against a postal parking PCN, within 28 days beginning with service. Respond to the formal notice even if an earlier informal challenge is unanswered.
The initial 50% discount applies for 14 days beginning with PCN service, or 21 days for an approved-device postal parking PCN. An early challenge may lead to a renewed discount if rejected; check the council's policy and the amount and deadline in its reply.
- The permit or waiver record identifying the authorised user, vehicle and location.
- The sign showing the required permit, any time limits and the relevant zone entrance.
- The council's display photographs or virtual-permit check.
- Vehicle-change, renewal or authorisation correspondence explaining a database or administrative discrepancy.
- Open Enfield's PCN service below. Enter the PCN reference (prefix EF) and vehicle registration to find the notice and evidence.
- Use your PCN number and vehicle registration to view CCTV or photographs and challenge through Enfield's linked parking portal. Check letters and digits carefully, particularly O and 0 or I and 1. If you have lost the PCN number, Enfield directs enquiries to pcnappeals@enfield.gov.uk.
- Include evidence supporting your reasons, such as relevant delivery paperwork, breakdown evidence or vehicle sale documents. The council's appeal page sets out the documents it asks for in different circumstances.
- For a parking challenge, relevant evidence may include a permit, pay-and-display ticket or mobile-parking booking reference.
- Enfield puts the case on hold once it receives an appeal and until it makes a decision. Do not pay if you intend to appeal, because payment closes the case.
- A removed vehicle must first be released from the car pound before its PCN can be appealed.
- Explain which part of the Code 16 allegation you dispute. Include the PCN reference, vehicle registration, your address and copies of photographs or records supporting each point.
- Postal alternative: NSL Limited, PO Box 65732, Enfield N13 9BL. Allow time for receipt before the deadline and retain proof of posting.
- Save the full submission, attachments and dated acknowledgement.
5. How long does Enfield have to respond?
Enfield must serve its decision within 56 days beginning with receipt of qualifying formal representations. If it fails to comply, those representations are deemed accepted. This statutory period applies to formal representations, not an informal challenge or a request for photographs.
[6]6. If Enfield rejects your representation
A formal Notice of Rejection explains Enfield's decision and how to appeal to London Tribunals. You have 28 days beginning with service of that notice to pay or register your tribunal appeal.
Compare the reply with the Code 16 grounds and evidence you submitted. Identify any unanswered point, missing evidence or inconsistency between the restriction and the recorded event. Keep the rejection notice and the appeal details supplied with it.
An informal rejection is different: formal representations can be made if a Notice to Owner follows.
[6][7]7. Taking your Enfield appeal to London Tribunals
London Tribunals is independent of Enfield. Use the registration instructions and verification details in the Notice of Rejection, upload your evidence and explain why the alleged Code 16 contravention or liability is disputed.
There is no fee to register the appeal. If it is refused, the full penalty is normally payable; an earlier discount does not automatically continue. If registering late, explain the delay so the adjudicator can decide whether to accept the appeal.

Teresa Brennan refused the appeal where a permit had expired and there was no evidence of the claimed renewal-system fault. A cancellation of another PCN for missing officer notes did not establish that this permit was valid.

Belinda Pearce allowed the appeal because the authority had not supplied evidence substantiating the alleged contravention. The parking order and plans did not establish what the vehicle was doing at the relevant time.
