Private car park

Before paying, match the company name, PCN reference and vehicle registration on your notice. Use the payment instructions on that notice or open Open Parking's website and find its Parking Charge payment service. A car park booking or parking tariff is separate from an issued Parking Charge Notice.

Check the Parking Charge First

A Parking Charge Notice is a contractual payment demand issued by a private parking company. It is different from a Penalty Charge Notice issued by a council or Transport for London. The notice should identify the parking operator, vehicle, location, alleged breach, amount, payment deadline and appeal instructions.

Check the operator's photographs and the complete notice before deciding. A charge may concern an overstay, unpaid tariff, incorrect registration, permit, restricted area, bay position or another displayed term. The decision should be based on what the operator alleges and what its evidence proves.

The government's private parking consultation guidance recognises that motorists can pay charges that might have been cancelled where signs, payment machines, mobile applications or ANPR records caused the problem. It also warns that ignoring a charge completely can result in debt recovery and a County Court Claim.

When Paying Makes Sense

Paying can be the lower-risk outcome when:

  • the notice and operator evidence accurately establish the alleged breach;
  • no payment, permit, booking, signage, accessibility or procedural issue supports cancellation;
  • the operator has answered the appeal evidence and a further appeal is unlikely to improve the position;
  • the discounted amount remains available and is preferable to contesting the full charge;
  • POPLA or the IAS has refused the independent appeal and you do not intend to defend a later court claim; or
  • a hire company has already paid the charge under the rental agreement and the remaining issue is the hire company's recharge or administration fee.

Pay the amount shown in the current document, not an amount copied from an earlier notice. Keep the payment confirmation and check that the operator records the Parking Charge as settled.

When an Appeal Makes Sense

Appeal a newly issued Parking Charge Notice when the allegation, amount, evidence, signs, parking terms or legal basis can reasonably be disputed. The current Private Parking Sector Single Code of Practice requires operators to allow 28 days for an appeal and to consider a late appeal where exceptional circumstances explain the delay.

Common issues include:

  • payment was made or attempted;
  • a valid permit, booking or customer authorisation existed;
  • the signs did not clearly communicate the term relied upon;
  • ANPR times do not establish the complete parking period;
  • the vehicle made two separate visits;
  • the operator did not allow the applicable consideration or grace period;
  • the Notice to Keeper or Notice to Hirer does not satisfy Schedule 4 of the Protection of Freedoms Act 2012;
  • the motorist required reasonable adjustments because of disability; or
  • the operator has pursued the wrong person or vehicle.

If you intend to appeal, do not pay first. The sector code permits an operator that accepts payment to end the appeal opportunity, provided the notice makes that consequence clear. The IAS appeal portal gives the same practical warning: payment may cause an operator to withdraw from, or refuse, the independent appeal.

Use the Discount Carefully

The notice should state the discounted amount and its deadline. Paying within that period closes the matter at the lower amount, but it normally also accepts the charge and ends the right to appeal.

An appeal made within the operator's deadline may preserve a reduced payment option, but the exact position must be taken from the notice, rejection and applicable appeal scheme. Do not assume every operator will keep the same discount open throughout POPLA or IAS.

The IAS states that a motorist who continues to an IAS appeal loses the ability to pay at the reduced rate if the appeal is unsuccessful. POPLA also explains that where the operator has offered a reduced amount, choosing the independent appeal may leave the full charge payable if POPLA refuses it.

After an Appeal Rejection

An operator rejection should give you a fresh decision between payment and an independent appeal. GOV.UK explains that BPA operators use POPLA and IPC operators use the IAS. The rejection should identify the correct service and provide the code or instructions needed to continue.

Pay after rejection when the response resolves the factual dispute, no supported ground remains and the available payment amount is the preferred outcome. Continue to POPLA or IAS when the rejection has not answered the evidence, the operator relies on an unsupported term or a legal or procedural ground remains material.

POPLA and standard IAS decisions that allow an appeal bind the operator and cancel the charge. If the appeal is refused, the operator may continue requesting payment. A refused independent appeal is not a County Court judgment, but payment at that point can prevent debt recovery and court escalation.

Hire and Lease Vehicles

A hired or leased vehicle requires the notice and rental agreement to be checked before anyone pays. The hire company may pay a charge and recharge the hirer where its contract permits that. The recharge and any administration fee are contractual matters between the hirer and hire company.

Payment is often practical where the hire company has already settled the operator's charge and the rental agreement clearly permits the recharge. If the hire company has not paid, it may be able to transfer liability instead. The sector code requires operators to provide a process for rental and leasing companies to transfer a Parking Charge to the hirer.

A Notice to Hirer can still be appealed. Schedule 4 of the Protection of Freedoms Act 2012 sets additional document and timing requirements where a parking operator seeks to recover an unpaid charge from a hirer. Do not assume the charge must be paid merely because the vehicle was hired.

Paying Outside the Discount

Once the discount has expired, paying the full charge may be sensible where no reliable appeal ground exists and the aim is to stop further correspondence. If the appeal period has also expired, ask the operator whether it will accept a late appeal before paying. The sector code requires consideration of late appeals supported by exceptional circumstances.

Being outside the discount period is not itself proof that the charge is valid. It changes the financial decision. Where the full amount is already demanded and a valid appeal remains available, a successful challenge can still reduce the charge to zero.

At debt recovery or Letter Before Claim stage, do not use an old payment link without checking the current creditor, balance and reference. The original charge, added amount and legal basis should be reviewed against the complete notice history before payment or settlement.

Avoid Parking Payment Scams

Use the payment address printed on the verified notice or the parking operator's official website. Check the company name, Parking Charge reference, vehicle registration and amount before entering card details.

Do not follow an unexpected text-message link simply because it mentions a parking charge. If the link or recipient differs from the notice, find the operator independently and confirm the current balance. Keep a screenshot or receipt showing the date, amount and payment reference.

Payment should result in written or online confirmation that the charge is settled. If the operator or debt company continues contacting you, send the confirmation and require its records to be corrected.

If You Do Nothing

Ignoring a private Parking Charge Notice does not make it disappear. The operator may send a reminder, instruct a debt recovery company, issue a Letter Before Claim and start a County Court Claim in England and Wales.

A Parking Charge Notice, reminder or debt letter does not itself create a County Court judgment. A CCJ risk arises if a court claim is issued and then not answered, or if judgment is entered and not paid as ordered. Each new document should therefore be answered at the stage it reaches.

The safest decision is an active one: pay when the charge is accepted and the amount is commercially preferable, or appeal promptly when supported grounds exist. Do not miss a deadline while deciding.
