Here are three simple steps we follow to defend a Premier Park claim.

1. Write your Premier Park defence

We will assess your Premier Park court claim and write a detailed defence for your case. Once your defence is ready, we will provide instructions on how to submit it to the county court business centre before the deadline.

You should keep a copy of the defence to read and go through to understand your case.

2. N180 Form - Allocation to Your Local Court

You will receive a copy of your N180 form which is used to transfer the court case to your local court. The N180 form will be sent after Premier Park confirm that they want to proceed.

Simply follow our simple instructions provided to send this document to the county court.

3. Witness Statement

We will use any information you give us to prepare your witness statement, this document summaries your defence and the facts of your case.

The witness statement will be submitted when your local court advises you to share documents with Premier Park.

4. Court Hearing

When your local court schedules the hearing, we will support you with instructions on what to do at the hearing.

If you win your case, don’t forget that you simply have to claim costs of minimum £95 to make sure you get compensation.

Frequently asked questions

Will I receive a Premier Park CCJ?

Many people misunderstand how a County Court Judgement CCJ is issued.

A CCJ is simply the decision made by the court. For example, if you win the case, the judge will make a judgement to dismiss the claim or if you lose the case, the judge will make a judgement to award the claim to the parking company. A CCJ will only stay on your account if you refuse to comply with the judge’s order.

If you lose the case, the CCJ simply instructs you to pay the amount in full within 30 days and there will be no record on your credit file.

If you win the case, the CCJ will simply state that the claim for money has been dismissed and Premier Park have no legal right to pursue you.

How long do claims take?

The duration of your claim depends entirely on your local court.

After the defence and N180 form are submitted, it is up to your local court to schedule the hearing date.

Some courts have a long backlog and therefore, it can take up to 6 months for a case to be assigned a date. During this time, you and Premier Park can be in contact to resolve the matter outside court.

Once the hearing is scheduled, Premier Park will have to pay a hearing fee if they feel they have a strong case.

Can I negotiate with Premier Park ?

Premier Park will unlikely negotiate a favourable outcome if they believe they have a strong case against you.

If you don’t file a defence, the court can make a judgement against you, this simply means that they will award the case in favour of Premier Park .

Therefore, you must file a defence as soon as possible.
