The driver said the traffic unexpectedly halted and that the car remained in the process of moving. The adjudicator examined the CCTV rather than accepting that account automatically.

There was a three- to four-second interval during which the vehicle might have stopped, but the footage could equally have shown continuing wheel movement. On the balance of probabilities, the adjudicator was not satisfied that there had been a stop. The appeal was allowed on 3 November 2025.
