TfL alleged a failure to comply with a prohibited-turn sign. The driver disputed that any sign prohibited the right turn taken and supplied a plan and annotated photographs. The point was specific: the presence of a restriction elsewhere would not establish a prohibition on this movement.

Michael Burke recorded that the authority's photograph did not show the signage relied upon. He considered the driver's evidence alongside Google Street View and was not satisfied that there was signage indicating that the right turn taken was prohibited. The appeal was allowed.

This decision illustrates an evidence gap, not a rule that every photograph must contain a sign or that Street View alone wins an appeal. What mattered was the relationship between the actual turn and the signing the authority needed to establish.

For a comparable appeal, mark the vehicle's path on a junction plan and identify the sign which the authority says applied to it. Explain what the evidence does and does not show. Date any photographs or Street View imagery and distinguish the position at the time of the PCN from later changes.
