The PCN concerned Station Parade and was issued by the London Borough of Barking and Dagenham. The motorist supplied evidence of a delivery to Vicarage Fields Service Yard. Access through the gates could not immediately be arranged because the intercom was not working, so the vehicle was left out of the way while access was sought.

The authority contested the appeal on the basis that the journey fell outside the loading and unloading exception's hours. Those materials showed a separate exception for access to the service yard or Vicarage Fields, without a time limit.
