What the Tribunal Decides

The Traffic Penalty Tribunal, usually shortened to TPT, is the independent adjudication body for civil traffic penalties outside London in England and across Wales. A tribunal appeal normally becomes available after the issuing authority has considered formal representations and served a Notice of Rejection.

An adjudicator decides whether the appellant remains liable for the penalty. The decision is made from the PCN, formal representations, Notice of Rejection, authority evidence, appellant evidence and the legislation governing that penalty type.

The authority is a party to the appeal but does not decide the outcome. TPT adjudicators are independent lawyers whose appointments are subject to the Lord Chancellor's consent.

Where TPT Has Jurisdiction

TPT handles appeals from more than 300 local and charging authorities in England outside London and Wales. The authority named on the Notice of Rejection determines the respondent to the appeal and the evidence that must be answered.

London borough and Transport for London PCNs go to London Tribunals, not TPT. Scottish PCNs go to the Parking and Bus Lane Tribunal for Scotland. Private Parking Charge Notices use the operator appeal followed by POPLA or the Independent Appeals Service. Speeding Fixed Penalty Notices and Notices of Intended Prosecution also fall outside TPT's jurisdiction.

The geographic boundary matters. A PCN issued in Birmingham, Bristol, Cardiff, Manchester, Nottingham or Sheffield may reach TPT, while a PCN issued by Camden or Transport for London does not.

Penalty Types TPT Covers

The tribunal decides appeals involving:

  • Civil parking PCNs issued on the vehicle or by post.
  • Bus lane and bus gate PCNs.
  • Moving traffic PCNs, including prohibited turns and yellow box junctions.
  • Clean Air Zone penalties and Oxford Zero Emission Zone penalties.
  • Dart Charge and Merseyflow crossing penalties.
  • Durham Road User Charge Zone and Oxford Congestion Charge penalties.
  • Littering from vehicles penalties issued by participating councils.

These penalties do not all use the same appeal grounds. Parking, bus lane and moving traffic cases in England are principally governed by the Traffic Management Act 2004 and the 2022 civil enforcement regulations. Welsh proceedings and road-user charging schemes use separate regulations.

TPT Workload in 2025-26

The TPT Annual Report 2025-26 gives the clearest current measure of its workload. It records 24,357 registered appeals and 3,468 statutory declaration or witness statement referrals, producing 27,825 total matters during the reporting year.

The report records 21,514 appeals determined, 7,152 appeals allowed and 10,029 refused. It also records 1,367 submitted appeals that were not registered because a required procedural element was missing or defective.

The public TPT website uses approximate descriptions of about 35,000 cases a year, while the report describes about 29,000 PCNs a year. Those are broad service figures. The dated 2025-26 totals are the better figures for understanding the current caseload.

Outcomes Need Proper Context

An allowed appeal can result from an adjudicator accepting the statutory ground, but it can also arise because the authority chooses not to contest. Of the 7,152 allowed appeals in 2025-26, 4,831 were not contested by the authority.

The difference is commercially important. The PCN is cancelled in either situation, but a non-contest means the authority withdrew after the tribunal case or further evidence was presented. It is not a decision that the adjudicator accepted the legal merits after hearing both parties.

Outcomes also vary by penalty type. The report records 3,519 parking appeals allowed, including 2,064 non-contests; 1,160 bus lane appeals allowed, including 866 non-contests; and 531 moving traffic appeals allowed, including 321 non-contests. A single headline win rate hides those differences.

Adjudicators and Legal Limits

Chief Adjudicator Caroline Hamilton explained in the 2025-26 report that motorists often incur civil penalties through misinformation or error rather than simply disregarding restrictions. She also emphasised that the tribunal's jurisdiction is limited.

An adjudicator makes findings of fact from the evidence and applies the law. The adjudicator cannot cancel a lawfully issued PCN merely because the circumstances are sympathetic. Where the regulations permit it, the adjudicator may recommend that an authority reconsider compelling reasons, but the authority decides whether to accept that recommendation.

The 2025-26 report records 21 part-time adjudicators working with the Chief Adjudicator. TPT is funded through the PATROL Joint Committee of participating authorities, but the adjudicators are independent office holders rather than employees of those authorities.

The FOAM Online Tribunal

TPT manages appeals through Fast Online Appeals Management, known as FOAM. The appellant can start the case using the PIN from the Notice of Rejection, explain the grounds, upload evidence, receive notifications and communicate with tribunal staff and the adjudicator.

Nearly 95% of appellants used the online system in 2025-26. TPT still accepts offline appeals and recorded 5.6% submitted by post or email. Assisted Digital support is available for people who cannot use the online service without help.

The case can be decided through an e-Decision on the documents or at a personal hearing by telephone or video. The adjudicator provides written reasons whichever method is used.

Decisions and Key Cases

An allowed appeal requires the authority to cancel the PCN. A refused appeal leaves the full penalty payable. TPT says that if payment is not received within 28 days after an unsuccessful decision, the authority can issue a Charge Certificate and increase the penalty by 50%.

TPT does not publish a complete searchable register equivalent to the London Tribunals statutory register. Its Publications Library links selected TPT and court decisions through the Traff-iCase key-cases website. Those decisions are curated because they clarify recurring facts, legal issues and motorists' obligations.

A previous tribunal decision may explain the law or be persuasive, but the current appeal still turns on its own PCN, evidence and statutory scheme. A decision should not be cited unless it is genuine and materially relevant.
