What Council Car Park PCNs Cover

An off-street Penalty Charge Notice concerns a council parking place or another site covered by statutory parking enforcement. It is not the same as a private company's contractual Parking Charge Notice. Check the issuing authority, code and notice wording before choosing your challenge. A council-owned site does not by itself establish which enforcement scheme applies.

Informal Challenges and Formal Representations

• PCN served on the vehicle or driver: send an informal challenge to the authority, identifying the off-street code, the parking place and the evidence supporting cancellation.
• Notice to Owner: the owner makes formal representations against the notice, normally within 28 days beginning with service. Repeat and develop the relevant evidence even if an earlier informal challenge was rejected.
• Postal parking PCN: respond formally to that PCN rather than waiting for a Notice to Owner. In England, regulation 10 permits postal PCNs based on an approved-device record for off-street parking. Check the device approval and the statutory parking scheme; the mere presence of a camera does not establish either.
• Notice of Rejection: appeal to the tribunal named on the rejection within the stated period, normally 28 days beginning with service. Submit the parking order, payment records and photographs that address the disputed condition.

For civil parking enforcement in England, read the 2022 General Regulations together with the separate 2022 Representations and Appeals Regulations. The traffic order and signs establish the local restriction; the enforcement regulations govern the notice and challenge process. Wales has separate regulations.

PCN Deadlines and Penalty Amounts

A parking PCN served on the vehicle normally offers 14 days at the discounted rate. An informal challenge does not automatically preserve that discount: check the authority's stated policy and reply. Formal representations and the authority's response duties depend on the legislation governing the notice. For English civil parking, qualifying formal representations engage the 56-day decision requirement; a complaint about a machine is not itself a formal representation.

For London borough parking enforcement, London Councils publishes higher/lower penalties of £160/£110 in Band A and £140/£90 in Band B. These are penalty levels, not the car park's parking tariff. Outside London, use the authority's published amount and the actual notice. A private Parking Charge follows different rules.

Evidence to Challenge the Parking Restriction

• The council PCN and photographs showing the car park name, entrance and terms.
• Payment confirmation, app history, ticket or permit with the registration and time visible.
• The off-street parking places order and any relevant suspension or closure notice.
• Wide photographs of the parking space and any alleged obstruction, with vehicle measurements if size is disputed.
• Machine fault reports, payment-attempt records, charging logs or correspondence relevant to the particular allegation.

Grounds to Challenge Council Car Park PCNs

• For payment allegations, match the receipt or parking-app record to the car park, registration and time. Not paying, not displaying a ticket and staying after paid time expired are different allegations.
• For a permit or disabled bay, check the qualification required by the off-street parking order and displayed terms. Show the valid permit, badge or authorisation and address any display requirement.
• For bay or restricted-area allegations, use wide photographs to show the bay boundary, markings, signs and exact position of the vehicle. Distinguish a minor overhang from the obstruction or positioning actually alleged.
• For overstay or return restrictions, compare arrival, expiry, departure and return records. If qualifying parking in a designated English parking place ended, test the statutory ten-minute protection before accepting an overstay PCN.
• For a closed, suspended or restricted car park, check the dates, opening hours and affected spaces. A suspension must cover the bay and time in question; an ordinary permit does not override it.

Off-street concessions are set by the relevant parking order and scheme. Do not assume a Blue Badge gives free parking in every council car park, or that roadside loading rules apply inside it. A machine fault needs to be considered alongside the payment instructions and available alternatives. Where the contravention occurred but there were exceptional circumstances, explain the request for discretion separately.

Explain the Ground and the Evidence Together

Identify the alleged contravention, explain the fact or exemption that answers it, and attach the supporting record. A payment screenshot should show the location and time; a camera challenge should identify the relevant sequence. Ask for cancellation on the applicable ground, with any request for discretion stated separately.

Send the Challenge to the Issuing Authority

Use the online representation form or postal address printed on the current notice. Include the PCN reference and registration, retain copies of all evidence and keep the submission confirmation. The issuing authority is the first decision-maker; the tribunal deals with an appeal after formal rejection.

If the Authority Rejects the Challenge

An informal rejection does not end the statutory parking process. Formal rejection provides the tribunal appeal instructions. Address the reasons given, keep the earlier evidence and submit the appeal in time. If the case is upheld, the penalty is cancelled; if refused, follow the decision's payment instructions. Failure to respond can lead to a Charge Certificate and later enforcement.
