Euro Car Parks PCN Cancelled. 5 Legal Defects Identified

A motorist received a parking charge notice from Euro Car Parks at a retail park in Leeds. The charge was £100 for allegedly parking without a valid permit. The motorist used Parking Mate AI to check the notice before paying.

What Our AI Found

Our AI PCN Manager identified five separate legal defects. This was one of the highest defect counts we have seen on a single notice.

1. Late Notice to Keeper
The NTK was dated 16 days after the alleged contravention, exceeding the 14-day statutory deadline under POFA 2012 Schedule 4.

2. Missing POFA Declaration
The notice did not contain the required keeper liability statement. Without this, Euro Car Parks cannot enforce the charge against the registered keeper.

3. Inadequate Signage
Photos provided by the motorist showed that the primary entrance sign was partially covered by vegetation and the permit requirements were stated in small text at the bottom of a large information board.

4. No Parking Period Stated
The notice stated the date of the contravention but did not state what time the vehicle was observed or how long it was parked.

5. Incomplete Evidence
The ANPR entry photograph showed a partial plate capture and the exit photograph was missing entirely.

The Result

A comprehensive appeal letter was generated citing all five defects with specific references to POFA 2012 and the BPA Code of Practice. The appeal was submitted directly to Euro Car Parks.

Euro Car Parks cancelled the charge within 21 days.

The motorist saved £100.

Key Takeaways

  • Euro Car Parks issues approximately 5,751 parking charges per day, making them one of the top 3 operators by volume.
  • Multiple defects significantly strengthen an appeal. Even if one ground is weak, having 4-5 alternative grounds makes it very difficult for the operator to defend.
  • Always provide photos of signage if possible. Signage defects combined with POFA failures create a very strong case.

The Discount Is Designed to Stop You From Checking Every private parking charge notice offers a reduced rate if you pay within 14 days. Typically £60 instead of £100. This seems like a reasonable offer. But the 14-day discount is a deliberate strategy to prevent motorists from checking whether the ticket is actually valid. Why […]
