How to Challenge a Notice of Enforcement
A Notice of Enforcement is the formal warning that enforcement agents (bailiffs) can begin taking control of goods, including clamping or removing a vehicle, if the debt is not dealt with.
At this stage, you still have options. In many cases you can apply to the Traffic Enforcement Centre (TEC) to put enforcement on hold and reset the process, especially where notices were not received, an appeal was in progress, or the case has escalated incorrectly.
A Notice of Enforcement is a formal notice from enforcement agents stating they intend to take enforcement action for an unpaid debt, such as a council PCN. It is usually issued after the debt has been registered and a warrant has been authorised.
At this stage, the focus is not whether the PCN was issued correctly, but whether you had a valid reason for being unable to file the statutory declaration or witness statement earlier. The court will assess whether the enforcement process was fair and whether your right to challenge was obstructed.
This is why the grounds used to challenge a Notice of Enforcement or Order for Recovery must be prepared correctly from the outset. If the statutory criteria are not met, the application will not succeed and enforcement may resume.

This depends on the type of contravention:
Parking: TE7 and TE9
Moving traffic: PE2 and PE3

Yes. If a council PCN is not resolved and the enforcement process reaches debt registration, enforcement agents may be instructed to recover the debt. This can include taking control of goods, including vehicles, under the relevant enforcement rules.
In most PCN enforcement situations, bailiffs cannot force entry into your home on a first visit. They can take control of goods outside, such as a vehicle on a public highway, and they may enter through an unlocked door if invited or allowed in. If you are unsure, get help immediately.
If the Traffic Enforcement Centre rejects your application, this does not always mean enforcement must continue.
In most cases, we will prepare a formal complaint to the local authority to address any procedural or enforcement issues that occurred during the enforcement process. This can include failures to respond to appeals, incorrect escalation, or enforcement action taken at the wrong stage.
If the TEC rejects your application, you may also be able to make a further application using the N244 form to ask the court to set aside the enforcement action and allow the statutory declaration to be accepted.

Missing statutory notices
Did you receive the original PCN and subsequent statutory notices, including the Charge Certificate and Order for Recovery?
Address and service problems
Have you moved address, changed keeper details, or have reason to believe notices were sent to the wrong address?
Vehicle keeper liability
Has the notice been issued to the correct vehicle keeper or is it a new vehicle purchase with history?
If any of these apply, enforcement should not continue.
