A CCJ Does Not Have to Stay on Your Credit Record

If a private parking operator obtained a County Court Judgment against you because you did not respond to a court claim, you can apply to have the CCJ set aside using an N244 application. If successful, the CCJ is removed from your credit record and the case goes back to the defence stage.

When Can You Set Aside a CCJ

You can apply to set aside a default CCJ if:

  • You did not receive the court claim (N1 form) and therefore did not know about it
  • You have a real prospect of successfully defending the claim
  • You acted promptly once you became aware of the judgment

The most common reason for not receiving the claim is that it was sent to an old address, or the claimant used incorrect address details.

The N244 Application Process

  1. Complete form N244. This is the application notice to set aside or vary a judgment. You can download it from the court service website.
  2. Prepare a witness statement. Explain why you did not receive the claim, when you became aware of the judgment, and why you believe you have a defence.
  3. Prepare your draft defence. The court wants to see that you have a real defence, not just a desire to delay. This is where POFA defects, signage issues, and evidence failures are critical.
  4. Pay the court fee. Currently £275 for an N244 application.
  5. File at court. Submit to the court that issued the judgment.

What Happens at the Hearing

A district judge will consider your application. They will look at:

  • Whether you acted promptly
  • Whether you have a good reason for not responding to the original claim
  • Whether your proposed defence has a real prospect of success

If the judge grants the set aside, the CCJ is removed and the case returns to the defence stage. You then file your full defence within the deadline set by the court.
