What On-Street Parking PCNs Cover

An on-street parking PCN concerns a vehicle waiting, parking or stopping on a road. The code identifies the allegation, but the restriction at that exact place and time matters more than the number alone. A loading exemption that answers a yellow-line PCN may not answer a loading-ban or bus-stop PCN.

Informal Challenges and Formal Representations

• PCN fixed to the vehicle or handed to the driver: send an informal challenge to the issuing authority using the address or online form on the PCN. Provide the code-specific facts and evidence while the notice is current.
• Notice to Owner: if one is served, the owner must make formal representations within the period stated on that notice, normally 28 days beginning with service. An earlier informal challenge does not replace this step.
• Postal parking PCN: make formal representations against the postal PCN. Do not wait for a separate Notice to Owner. Postal service must be authorised, for example an eligible camera contravention, prevented service or a qualifying drive-away.
• Notice of Rejection: an independent tribunal appeal is normally due within 28 days beginning with service. London cases go to London Tribunals; relevant cases elsewhere in England and Wales go to the Traffic Penalty Tribunal.

For civil parking enforcement in England, read the 2022 General Regulations together with the separate 2022 Representations and Appeals Regulations. The traffic order and signs establish the local restriction; the enforcement regulations govern the notice and challenge process. Wales has separate regulations.

PCN Deadlines and Penalty Amounts

An English parking PCN served on the vehicle normally offers 14 days at the discounted rate. An approved-device postal parking PCN normally offers 21 days; qualifying prevented-service and drive-away postal notices use 14. The authority's duty to decide qualifying formal parking representations within 56 days must not be confused with the handling of an informal challenge. Check the notice, service date and legislation before calculating the last day.

London Councils lists borough parking Band A penalties at £160 higher level and £110 lower level, and Band B at £140 and £90. The applicable band, contravention level and date determine the charge. TfL sets its own red-route parking charges. These borough figures are not national parking rates.

Evidence to Challenge the Parking Restriction

• The PCN, the CEO's observation notes and photographs of the vehicle position.
• The applicable bay sign, controlled-zone entrance or suspension notice, photographed with its location visible.
• Payment and permit records that show the vehicle, location, date and validity period.
• For loading or assisted boarding: delivery notes, the premises visited, a short timeline and relevant witness evidence.
• For a dropped-kerb or distance-from-kerb allegation: wide photographs, measurements and the purpose of the lowered or raised crossing.

Grounds to Challenge On-Street Parking PCNs

• Was the restriction operating? Compare the PCN time with the bay sign or controlled parking zone hours. Double yellow lines normally do not need a time plate; the absence of a nearby sign is not by itself a ground to cancel them.
• Does the vehicle position establish the allegation? For a bay, dropped kerb or footway PCN, use photographs showing the whole vehicle and the boundaries, not just a close-up of the number plate.
• Did an exemption apply? Loading, boarding, a qualifying Blue Badge concession, an authorised suspension exemption or a statutory works exemption have different conditions. Show what was actually happening and for how long.
• Was paid or permitted parking still valid? Check payment timestamps, vehicle registration, location number and permit zone. An expired permit and having no permit at all can lead to different codes and penalty levels.
• Was a qualifying English parking-place PCN issued within ten minutes after the permitted period ended? This statutory protection is not a ten-minute allowance on yellow lines or a no-stopping restriction.

There is no single exemption list for every parking code. Ordinary loading can be permitted on yellow lines but prohibited where a loading restriction is in force. Blue Badge concessions have local and location-specific limits, especially in parts of central London. The code guides identify the relevant questions; the traffic order and applicable legislation establish the conditions.

Explain the Ground and the Evidence Together

Identify the alleged contravention, explain the fact or exemption that answers it, and attach the supporting record. A payment screenshot should show the location and time; a camera challenge should identify the relevant sequence. Ask for cancellation on the applicable ground, with any request for discretion stated separately.

Send the Challenge to the Issuing Authority

Use the online representation form or postal address printed on the current notice. Include the PCN reference and registration, retain copies of all evidence and keep the submission confirmation. The issuing authority is the first decision-maker; the tribunal deals with an appeal after formal rejection.

If the Authority Rejects the Challenge

An informal rejection does not end the statutory parking process. Formal rejection provides the tribunal appeal instructions. Address the reasons given, keep the earlier evidence and submit the appeal in time. If the case is upheld, the penalty is cancelled; if refused, follow the decision's payment instructions. Failure to respond can lead to a Charge Certificate and later enforcement.
